Nearly 50 South African lawyers, led by attorney Wikus Van Rensburg, are gearing up to file a lawsuit against the United States and Britain, asserting their complicity in Israeli forces’ war crimes in Palestine, Anadolu Agency reports. This initiative follows South Africa’s filing of a genocide case against “Israel” at the International Court of Justice (ICJ).

Rensburg, the driving force behind the legal action, aims to prosecute those complicit in the crimes through civilian courts, collaborating with legal professionals in the U.S. and Britain.

In an interview with Anadolu, Rensburg emphasized the need to hold the U.S. accountable for its actions and highlighted the forthcoming legal proceedings against Washington and London.

South Africa’s Minister of International Relations, Naledi Pandor, has warned that all states have a legal obligation to uphold the provisional measures ordered by the ICJ in regard to Israel’s actions in Gaza, adding that failure to do so is complicity in the crimes of genocide.

“Despite its claims, these orders are binding upon Israel. It has to immediately implement these provisional measures to prevent a further increase of its human rights violations,” Pandor said on Sunday. She was speaking at a public report back session on the case, at a Cape Town mosque.

“Regardless of the fact that the International Court of Justice today did not issue a direct decision to stop the aggression on the Gaza Strip and our rejection of what was mentioned in the decision regarding the legitimate operation of October 7th against the brutal occupation, what was included in the text of its decisions today regarding the response to South Africa’s invitation is a historic decision, and a victory for justice and the Palestinian cause, especially since there is almost consensus from the court judges to proceed in considering the invitation presented by South Africa.”

The war wasn’t won with the Jan. 26 ruling by the International Court of Justice calling on Israel to “prevent death, destruction and any acts of genocide in Gaza.” But a battle was won by exposing and weakening Israel, forcing the ICJ to recognize almost every point in South Africa’s charges and to take up the issue of genocide.

South Africa was clear about the necessity of calling for an immediate ceasefire. Many were hoping for this as well. But the ICJ failed humanity on that point and fell into its historic Western imperialist biases by demanding Hamas release Israelis captured during the conflict while ignoring the much greater number of Palestinians kidnapped by the Israeli “Defense” Forces (IDF). 

The ICJ also seemingly forgot that the ongoing occupation of Palestine establishes the right to fight that occupation. It ignored the right of self-defense of Palestinians in Gaza and the West Bank.

The Republic of Cuba has been a State Party to the Convention on the Prevention and Punishment of the Crime of Genocide since 1953 and, in accordance with the commitments undertaken in that framework, has the obligation to prevent and punish genocide.

In this context, it expresses its support for the request of the Republic of South Africa to initiate proceedings against Israel in the International Court of Justice in relation to violations by that country of its obligations under the Convention on the Prevention and Punishment of the Crime of Genocide.

A news conference was called on Jan. 9 to support the petition of South Africa to the International Court of Justice charging “Israel” with genocide. “Keep hope alive” was the event’s theme, which was held in front of the South African Mission to the United Nations in New York City.

The conference was called by the Palestinian Assembly for Liberation (PAL), Al-Awda NY: The Palestinian Right to Return Coalition, and its Commission on War Crimes, Justice, Reparations and Return.

We take inspiration from previous mobilizations by trade unions in Italy, South Africa and the United States and similar international mobilizations against the Italian invasion of Ethiopia in the 1930s, the fascist dictatorship in Chile in the 1970s and elsewhere where global solidarity limited the extent of colonial brutality.

We are calling on trade unions in relevant industries:

  1. To refuse to build weapons destined for Israel.
  2. To refuse to transport weapons to Israel.
  3. To pass motions in their trade union to this effect.
  4. To take action against complicit companies involved in implementing Israel’s brutal and illegal siege, especially if they have contracts with your institution.
  5. Pressure governments to stop all military trade with Israel and, in the case of the U.S., stop funding it.
